Terms of Service
These Terms of Service (“Terms”) govern your use of PermitIndex, operated by {Legal Business Name}(“PermitIndex,” “we,” “us,” or “our”). By creating an account or using our service, you agree to these Terms.
These Terms will be reviewed by a Canadian lawyer before the public launch of PermitIndex (Phase 3). Until that review is complete, treat this as a working draft. The {Legal Business Name} placeholder will be replaced with the registered business name before public launch.
1. The service
PermitIndex provides a searchable, alerting feed of Toronto construction-activity data derived from the City of Toronto Building Permits dataset. The service delivers territory and market intelligence — specifically: where construction activity is occurring, what trade category is involved, the estimated construction value, and the permit date. We sell intelligence, not leads.
PermitIndex does not provide contractor names, owner names, or contact information of any kind. The service is not a lead-generation tool and must not be used as one. Any description of the service as a source of “leads” or “contacts” is incorrect.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use PermitIndex. By using the service, you represent that you meet these requirements.
3. Your account
You are responsible for maintaining the security of your account. Accounts are personal and may not be shared. You must provide an accurate email address. We use magic-link (passwordless) authentication; keep your email account secure.
4. Subscription plans and billing
PermitIndex offers Free, Pro ($49/mo CAD), and Business ($99/mo CAD) plans. Plan capabilities are described on the pricing page. Billing is processed by our payment processor (Stripe or LemonSqueezy). We do not store card numbers. Subscriptions renew monthly until cancelled. You may cancel from your billing page at any time; your plan reverts to Free at the end of the paid period. No refunds for partial periods.
5. Acceptable use
You agree not to:
- Resell, sublicense, or redistribute PermitIndex data or alerts to third parties without our written permission.
- Systematically scrape, crawl, or harvest data from PermitIndex beyond what is delivered through the normal interface or API (API tier, v1.1).
- Use the service to harass, stalk, or contact any individual based on permit address data.
- Represent our data as providing contractor, owner, or occupant contact information — it does not.
- Use the service for any purpose that violates applicable law, including PIPEDA and CASL.
- Attempt to circumvent access controls or entitlement gates.
6. Data accuracy — no warranty
PermitIndex data is derived from the City of Toronto Open Data portal. We clean, geocode, and classify the raw records, but we do not guarantee the accuracy, completeness, or timeliness of any permit record. Permit values are as filed by the applicant and may not reflect actual construction costs. Geocoding is approximate. Trade classifications are algorithmic and may be incorrect. You use the data at your own risk.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PERMITINDEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) CAD $100.
8. Intellectual property
The PermitIndex platform, design, software, and trade classification methodology are our property. The underlying permit data is published by the City of Toronto under the Open Government Licence – Toronto; your use of that data through our service is also subject to that licence. CSV exports include the mandatory OGL attribution.
9. Termination
We may suspend or terminate your account for violation of these Terms, non-payment, or any activity that we believe puts the service or other users at risk. You may delete your account at any time from your account settings page.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute shall be resolved in the courts of Ontario.
11. Changes
We will update these Terms following the lawyer review before public launch. Material changes will be emailed to account holders with at least 14 days' notice.
